THE construction of a $1.5 million, 24-hour Subway outlet in Robinvale may hinge on the outcome of a mediation between the franchisee, Swan Hill Rural City Council (SHRCC), and a group of residents opposing the development.
Councillors last year voted unanimously to grant a planning permit allowing the Bromley Road proposal to proceed.
But some residents are firmly against it, lodging an appeal with the Victorian Civil and Administrative Tribunal (VCAT) earlier this year to block the development, citing concerns including planning and zoning, traffic congestion and pedestrian safety, “the building itself”, signage and whether the development fitted the “character of the neighbourhood”.
SHRCC chief executive John McLinden said the council “won’t be supporting any mediation decision that sees the development stall”.
“Council has made its position pretty clear — it supports the development, that’s why (it) made the decision to issue the (planning) permit,” Mr McLinden said.
“We would have issued that permit had the decision not been appealed … but once the appeal is lodged, obviously council can’t issue the permit until VCAT resolves the matter.
“For that reason, we certainly will be participating in the mediation and trying to bring this matter to a resolution.
“If a mediated position can be arrived at that sees the development proceed, council will support that.
“If mediation doesn’t resolve the matter, then I understand it’s listed for hearing in September and again, council will be participating in any VCAT hearing with a view of trying to get the matter resolved and the development to proceed.”
Planning consultant Roy Costa, who represents Subway’s franchise owner, said the development, which includes a restaurant, alfresco dining area and drive-through facilities, “will not affect the surrounding heritage areas or create traffic hazards or congestion”.
” (We are) hoping a resolution is reached and the objectors’ concerns can be addressed,” Mr Costa said.
“If not, the matter will not be determined until September this year.
“COVID-19 has created major financial concerns for community and sporting groups, with Subway to provide financial support to these groups it is more important now than ever.”
The opposing group of residents declined to comment.
The VCAT mediation has been set for May.
